The software includes a user interface for managing functions and settings, available at https://ityman.ru or using the Software Interaction Protocol (API) at https://ityman.ru .
1.3. License – the Licensee's right to use the Software while retaining the Licensor's right to issue licenses to other persons (a simple (non-exclusive) license). The License parameters (Software usage period, limit on the number of Subscribers, etc.) are selected by the Licensee in his Personal Account at the time of placing an order for a License.
1.4. Licensor's Website – the website at https://ityman.ru .
1.5. The Operator is the end user of the Software, who has an account to log into his Personal Account, and is authorized to receive incoming dialogues using the Software.
1.6. Personal Account – user interface for managing software functions and settings, available at https://ityman.ru .
1.7. Tariff – the cost of using the Software, determined by the Licensor and posted on the Licensor's Website. The Licensee purchases Licenses in his Personal Account according to the Tariff in force at the time of purchase of the License.
1.8. Authorization by call (Call-password) - confirmation of the phone number using an auto-call (the functionality allows for full registration of users who do not have a Telegram).
1.9. Recipient – any natural and (or) legal person receiving Messages sent by the Licensee using the Software.
1.10. Subscriber is a visitor to the Licensee's website or other channels of communication with clients/potential clients/ audience of the Licensee who voluntarily subscribed to receive text and multimedia messages from the Licensee using third—party short message exchange platforms (messengers), which, if necessary, can serve as an unconditional confirmation of this.
1.11. Message – a single electronic message generated, sent or received using the Software.
1.12. Spam - mailing of messages sent to Recipients without the prior consent of the Recipients, as well as mailing that misleads Recipients about the content of Messages or their sender, including: mass mailing of Messages that were not previously agreed with the Recipient, i.e. mailing to multiple Recipients or multiple mailing to one Recipient, mailing information to Recipients who previously expressed obvious reluctance to receive this information.
2. SUBJECT OF THE AGREEMENT
2.1. The subject of this Agreement is the Licensor's granting of non-exclusive rights to use the Program's functions (hereinafter referred to as "Access to the Program") To the Licensee on the terms of a simple (non-exclusive) license for independent use by the Licensee without the right to sublicense to third parties in accordance with the Tariff Plan chosen by the Licensee.
2.2. The Licensee has the right to use the Software in the following ways:
2.2.1. Get access to the Software around the clock, except for periods of technical work;
2.2.2. Use all the functionality of the Software specified in the License.
2.3. The Licensee does not have the right to transfer the right to use the Software to third parties.
2.4. Before concluding the Agreement, the Licensee has familiarized himself with the technical capabilities of the Software and its functionality, and agrees to receive the Software in the form in which it exists at the time of conclusion of the agreement. Any software improvements and bug fixes are carried out only at the Licensor's discretion and within a time frame acceptable to the Licensor.
2.5. The Licensee has the right to use the Software during the term of the License, provided that the obligations provided for in the Offer are properly fulfilled, without restriction on the territory of use.
3. THE PROCEDURE FOR CONCLUDING AND EXECUTING THE CONTRACT
3.1. The Licensee is obliged to familiarize himself with the contents of the Agreement, the description of the Service on the Website and the Tariffs from the moment of performing the actions considered acceptance in accordance with clause 3.4 of the Agreement.
3.2. In order to obtain the right to access the Software for the purpose of its use, the Licensee undertakes to register on the Licensor's Website before using the Software.
3.3. Upon registration, the Licensee:
undertakes to enter reliable data required for registration;
Confirms that the use of the Software will be carried out in accordance with the terms of the Offer, all norms and requirements of Russian legislation (including, but not limited to, legislation on advertising, protection of competition, intellectual property legislation), and will not violate any rights of third parties and the rights of the Licensor.
3.4. After registration on the Licensor's website, the Licensee is provided with test access to the Software for no more than 14 (fourteen) days, during which the Licensee can familiarize himself with the available functionality and decide to use the Software in the future. If a decision is made to use the Software, the Licensee, who has previously registered on the Licensor's website, enters the necessary data in his Personal Account, selects a tariff and can pay the license fee provided for in section 5 of this offer.
3.5. The Licensor has the right to unilaterally change the Agreement and the Tariffs provided for by the Licensor's website at any time. From the moment of posting a new version of the Agreement and/or Tariffs, the Parties are guided by the provisions of the new version of the Agreement and/or Tariffs. This does not apply to an already paid License until the end of the paid period.
3.6. The Licensee is obliged to familiarize himself in a timely manner with the messages that the Licensor sends to the Licensee by e-mail and/or through his Personal Account. All risks caused by the Licensee's untimely familiarization with the messages are borne by the Licensee himself.
3.7. The Parties have agreed that e-mail and/or Personal Account messages are legally binding for the Parties and are recognized by them.
3.8. The Licensee is obliged to use the Software only in the ways provided for in this Agreement and according to the restrictions determined by the License (selected in the Personal Account).
3.9. The Licensor may carry out technological interruptions in providing access to the Software, which are considered as providing access to the Software in normal mode and are not grounds for recalculating the amounts paid by the Licensee. Technological breaks can be carried out, among other things, to update the functionality of the software. Technological breaks may not exceed 4 hours in one calendar month.
4. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1. The Licensee is obliged to:
4.1.1. Do not modify the source code of the software.
4.1.2. Do not modify the appearance of the Software user interfaces.
4.1.3. To make timely and full payment of remuneration for granting the right to use the Software in the manner and within the time limits provided for by the Offer.
4.1.4. Do not transfer the details of access to the software to third parties and maintain their confidentiality. The Parties agreed to consider all actions performed using the Licensee's access details to the Software as done by the Licensee, as well as at the will and with the consent of the Licensee. The Licensor is not liable to the Licensee for any damage suffered by the Licensee due to the authorized or unauthorized transfer of the Licensee's access details to the Software.
4.1.5. Do not use the SOFTWARE:
for sending SPAM;
for the intentional transmission of Messages that may lead to a malfunction of the software;
to transmit Messages of an offensive or defamatory nature, Messages inciting national, racial or religious discord, pornographic messages;
to transmit Messages in the text of which part of the essential information about the advertised product is missing, about the conditions of its purchase or use, if the meaning of the information is distorted and the subscriber is misled. Настоящее Лицензионное соглашение регулирует использование программы для ЭВМ «ITYMAN», предназначенной для создания, настройки и эксплуатации чат-ботов, текстовых ИИ-сотрудников, автоматизированных сценариев взаимодействия и интеграций с внешними информационными системами.
Лицензиаром является индивидуальный предприниматель ПАНДЖАКИДЗЕ ВАХТАНГ МАМУЛИЕВИЧ, ИНН 165037760449, ОГРНИП 321169000131764.
Перед регистрацией, подключением интеграций, началом пробного периода, оплатой или иным использованием Программы Пользователю необходимо ознакомиться с настоящим Соглашением. Использование Программы допускается только при полном и безоговорочном согласии с его условиями.
1.1. Настоящее Соглашение заключается между индивидуальным предпринимателем ПАНДЖАКИДЗЕ ВАХТАНГОМ МАМУЛИЕВИЧЕМ, далее — «Лицензиар», и физическим лицом, индивидуальным предпринимателем или юридическим лицом, использующим Программу, далее — «Пользователь».
1.2. Настоящее Соглашение является договором присоединения. Условия Соглашения определяются Лицензиаром и принимаются Пользователем в полном объеме.
1.3. Соглашение заключается в упрощенном порядке, предусмотренном законодательством Российской Федерации для программ для ЭВМ. Начало использования Программы признается согласием Пользователя заключить Соглашение на изложенных в нем условиях.
1.4. Акцептом настоящего Соглашения признается совершение Пользователем любого из следующих действий:
1.5. С момента акцепта настоящее Соглашение считается заключенным в письменной форме посредством обмена электронными данными.
1.6. Лицо, использующее Программу от имени юридического лица или индивидуального предпринимателя, подтверждает наличие необходимых полномочий на заключение настоящего Соглашения.
1.7. Если Пользователь не согласен с условиями настоящего Соглашения, он обязан не регистрироваться, не активировать пробный период, не оплачивать подписку и прекратить использование Программы.
2.1. Программа — программа для ЭВМ «ITYMAN», включая ее программный код, серверные компоненты, пользовательские интерфейсы, базы данных, документацию, обновления и иные элементы, исключительные права на которые принадлежат Лицензиару либо используются им на законных основаниях.
Государственная регистрация программы для ЭВМ подтверждается свидетельством № 2022668055.
2.2. Платформа — программно-техническая среда, посредством которой Пользователю предоставляется удаленный доступ к функциональным возможностям Программы.
2.3. Учетная запись — совокупность данных и средств авторизации, позволяющих идентифицировать Пользователя и предоставлять ему доступ к Программе.
2.4. ИИ-сотрудник — созданный и настроенный Пользователем автоматизированный программный сценарий, который с применением технологий искусственного интеллекта формирует текстовые ответы, обрабатывает обращения, выполняет заданные действия и взаимодействует с внешними информационными системами.
2.5. Интеграция — техническое подключение Программы к стороннему сайту, приложению, CRM-системе, мессенджеру, социальной сети, телефонии, электронной почте, API или иной информационной системе.
2.6. Тариф — опубликованный Лицензиаром набор условий использования Программы, включая стоимость подписки, доступные функции, лимиты, количество пользователей, ИИ-сотрудников, интеграций и исходящих сообщений.
2.7. Исходящее сообщение — текстовое или иное сообщение, сформированное и отправленное ИИ-сотрудником либо иным автоматизированным инструментом Программы получателю, пользователю внешнего сервиса или подключенной информационной системе.
2.8. Пользовательские данные — информация, загружаемая, создаваемая, передаваемая или обрабатываемая Пользователем посредством Программы, включая тексты, инструкции, базы знаний, файлы, настройки, переписку и данные интеграций.
3.1. Лицензиар предоставляет Пользователю право использования Программы на условиях простой неисключительной лицензии, а Пользователь обязуется соблюдать настоящее Соглашение и оплачивать использование Программы в случаях, предусмотренных выбранным Тарифом. Простая неисключительная лицензия не препятствует Лицензиару самостоятельно использовать Программу и предоставлять права на нее другим лицам.
3.2. Право использования предоставляется исключительно в пределах функциональных возможностей Программы, доступных Пользователю в соответствии с выбранным Тарифом или условиями пробного периода.
3.3. Пользователь вправе:
3.4. Право использования Программы предоставляется на территории Российской Федерации.
Указание территории определяет территориальные пределы предоставленной лицензии и не означает передачу исключительных прав, предоставление исключительной лицензии или ограничение права Лицензиара выдавать лицензии другим лицам.
3.5. Лицензия предоставляется на срок действия пробного периода или оплаченной подписки. По окончании соответствующего периода право использования платных функций прекращается, если подписка не была продлена.
3.6. Право использования Программы предоставляется без передачи исходного кода, алгоритмов, серверной инфраструктуры, средств разработки и иных технических материалов, не включенных в общедоступный интерфейс или документацию.
3.7. Количество ИИ-сотрудников, пользователей, подключаемых интеграций, доступных функций и объем использования определяются соответствующим Тарифом.
3.8. В составе Программы могут использоваться программные компоненты, языковые модели, API и сервисы третьих лиц. Права на такие компоненты принадлежат их правообладателям, а их использование может дополнительно регулироваться условиями соответствующих третьих лиц.
4.1. Пользователю может быть предоставлен бесплатный пробный период продолжительностью 14 календарных дней с момента его активации.
4.2. Если иное прямо не указано Лицензиаром, один пробный период предоставляется одному Пользователю, одному юридическому лицу или индивидуальному предпринимателю однократно.
4.3. В течение пробного периода Лицензиар вправе устанавливать ограничения на количество ИИ-сотрудников, интеграций, пользователей, сообщений, объем базы знаний и иные функции.
4.4. Окончание пробного периода само по себе не влечет автоматического списания денежных средств. Платное использование начинается после выбора Пользователем Тарифа и подтверждения оплаты либо подключения периодических платежей.
4.5. Основные коммерческие условия использования Программы определяются следующим образом:

4.6. Оплата использования Программы состоит из двух самостоятельных компонентов:
4.7. Стоимость подписки, стоимость одного исходящего сообщения, включенные лимиты, расчетный период, порядок списания и иные финансовые условия указываются в действующем Тарифе, интерфейсе оплаты или выставленном счете.
4.8. При подключении автоматического продления подписки Пользователь дает согласие на периодические платежи. Пользователь вправе в любое время отказаться от дальнейшего использования ранее предоставленных платежных реквизитов посредством доступного электронного способа или обращения к Лицензиару. После получения такого отказа Лицензиар не использует соответствующие реквизиты для последующих периодических платежей.
4.9. Отключение автоматического продления не прекращает доступ до окончания уже оплаченного периода и не отменяет обязанность оплатить ранее учтенные исходящие сообщения.
4.10. Учет исходящих сообщений осуществляется техническими средствами Программы. При отсутствии доказанной технической ошибки данные системы учета Лицензиара используются для определения объема потребления.
4.11. При недостаточности средств, истечении оплаченного периода, превышении лимита или наличии задолженности Лицензиар вправе ограничить формирование исходящих сообщений, приостановить отдельные функции либо доступ к Программе до устранения соответствующего обстоятельства.
4.12. При прекращении использования Программы расчеты и возврат денежных средств производятся с учетом фактически предоставленного периода доступа, фактически учтенных исходящих сообщений, условий Тарифа и обязательных требований законодательства Российской Федерации.
5.1. Исключительное право на Программу, ее программный код, архитектуру, интерфейсы, дизайн, базы данных, документацию, обозначения и обновления принадлежит Лицензиару либо соответствующим правообладателям.
5.2. Настоящее Соглашение не предусматривает отчуждения исключительного права или передачи Пользователю каких-либо прав, прямо не указанных в Соглашении.
5.3. Пользователь сохраняет права на принадлежащие ему Пользовательские данные, тексты, файлы, инструкции, базы знаний и иные материалы.
5.4. Пользователь предоставляет Лицензиару право технически использовать Пользовательские данные в объеме, необходимом для: исполнения настоящего Соглашения; хранения и обработки данных; формирования ответов и исходящих сообщений; работы интеграций; обеспечения информационной безопасности; технической поддержки и устранения ошибок.
5.5. Пользователь вправе предоставлять доступ к Программе своим работникам и привлеченным исполнителям, действующим в интересах Пользователя. Пользователь несет ответственность за их действия как за свои собственные.
5.6. Без предварительного письменного согласия Лицензиара Пользователю запрещается:
5.7. Пользователь вправе изменять настройки, сценарии, инструкции, базы знаний, интеграции и иные доступные элементы посредством штатных средств Программы. Изменение программного кода, обход технических ограничений, декомпиляция, дизассемблирование и обратная разработка запрещаются, кроме случаев, прямо предусмотренных обязательными нормами законодательства Российской Федерации.
5.8. Пользователю запрещается удалять, скрывать или изменять сведения об авторском праве, товарных знаках, правообладателях и иных обозначениях, размещенных в Программе или документации.
5.9. Пользователь обязан: предоставлять достоверные регистрационные и платежные данные; обеспечивать конфиденциальность паролей, ключей API и иных средств доступа; незамедлительно уведомлять Лицензиара о несанкционированном доступе; самостоятельно проверять настройки ИИ-сотрудников до их запуска; контролировать содержание автоматически формируемых сообщений; соблюдать законодательство, правила подключенных сервисов и права третьих лиц; своевременно оплачивать подписку и использование искусственного интеллекта.
5.10. Запрещается использовать Программу: для нарушения законодательства Российской Федерации; для распространения вредоносного программного обеспечения; для неправомерного доступа к информации или информационным системам; для мошенничества, фишинга, введения получателей в заблуждение или выдачи себя за другое лицо; для массовых нежелательных рассылок и спама; для нарушения авторских, смежных, исключительных, личных неимущественных и иных прав; для создания незаконного, экстремистского, дискриминационного или иного запрещенного контента; для обхода ограничений, лимитов, систем безопасности или механизмов учета; способом, создающим чрезмерную или вредоносную нагрузку на инфраструктуру Лицензиара.
5.11. Пользователь не вправе загружать в Программу государственную тайну, данные банковских карт, пароли третьих лиц, биометрические персональные данные, специальные категории персональных данных или иную информацию ограниченного доступа, если возможность такой обработки прямо не согласована с Лицензиаром отдельным соглашением.
6.1. Диалоги, сообщения и связанные с ними технические данные хранятся в Программе в течение 3 месяцев с даты последнего сообщения в соответствующем диалоге, если Пользователь не удалил их ранее, иной срок не установлен законодательством Российской Федерации, или более длительное хранение не требуется для разрешения спора, исполнения обязанности по хранению документов или обеспечения информационной безопасности.
6.2. После истечения срока хранения диалог может быть удален или обезличен без дополнительного уведомления Пользователя.
6.3. Пользователь обязан самостоятельно сохранять необходимые ему диалоги и сведения до истечения срока хранения. Лицензиар не обязан восстанавливать удаленные данные, если иное прямо не предусмотрено Тарифом.
6.4. Удаленные данные могут временно сохраняться в резервных копиях до их плановой перезаписи. Такие копии не используются для обычной работы Программы и обрабатываются исключительно для восстановления, безопасности и выполнения требований законодательства.
6.5. В отношении регистрационных, платежных и технических данных Пользователя Лицензиар выступает оператором персональных данных и обрабатывает их в соответствии с законодательством Российской Федерации и опубликованной Политикой обработки персональных данных.
6.6. В отношении персональных данных, которые Пользователь передает через диалоги, базы знаний, интеграции и иные функции Программы, Пользователь самостоятельно определяет цели и правовые основания обработки и, как правило, выступает оператором персональных данных, а Лицензиар осуществляет техническую обработку таких данных по поручению Пользователя.
6.7. В рамках указанного поручения Лицензиар вправе совершать с персональными данными следующие действия с использованием средств автоматизации или без них: сбор, запись, систематизация, накопление, хранение, уточнение и обновление, извлечение, использование, передача подключенным Пользователем интеграциям и технологическим поставщикам, обезличивание, блокирование, удаление, уничтожение.
6.8. Целями обработки данных по поручению Пользователя являются предоставление функциональности Программы, работа интеграций, формирование и отправка сообщений, выполнение настроенных сценариев, обеспечение безопасности, техническая поддержка и устранение ошибок.
6.9. Перечень обрабатываемых данных может включать имя, фамилию, контактные данные, идентификаторы пользователей внешних сервисов, содержание сообщений, сведения о действиях, технические параметры и иные данные, которые Пользователь передает посредством Программы.
6.10. Пользователь поручает Лицензиару привлекать для обработки данных поставщиков хостинга, вычислительной инфраструктуры, языковых моделей, средств связи, аналитики и интеграций при условии соблюдения применимых требований к конфиденциальности и безопасности.
6.11. Пользователь самостоятельно обязан: иметь законное основание для обработки и передачи персональных данных; предоставить субъектам персональных данных необходимые уведомления; получить согласия, если они требуются законодательством; рассматривать обращения субъектов персональных данных; не передавать избыточные или запрещенные данные; настроить ИИ-сотрудников с учетом требований законодательства и правил используемых каналов связи.
6.12. Лицензиар принимает необходимые правовые, организационные и технические меры для защиты обрабатываемой информации, однако не гарантирует абсолютную защищенность данных от всех возможных угроз.
7.1. Техническая поддержка предоставляется в объеме и порядке, предусмотренных выбранным Тарифом, документацией и информацией, опубликованной Лицензиаром.
7.2. Поддержка может включать консультации по регистрации, настройке, интеграциям, работе штатных функций и устранению воспроизводимых технических ошибок.
7.3. Если отдельным соглашением или Тарифом не предусмотрено иное, Лицензиар не гарантирует конкретный срок ответа, время устранения ошибки или установленный показатель доступности Программы.
7.4. Лицензиар вправе выпускать обновления, исправления и новые версии Программы. Обновления могут устанавливаться автоматически и становиться неотъемлемой частью Программы.
7.5. Лицензиар вправе изменять интерфейс, алгоритмы, состав интеграций и отдельные функции, в том числе в связи с развитием Программы, требованиями законодательства, безопасностью или изменениями сервисов третьих лиц.
7.6. Для технического обслуживания, обновления или устранения угроз Лицензиар вправе временно ограничить доступ к Программе. При наличии разумной возможности Лицензиар предварительно уведомляет Пользователя о плановых работах.
7.7. Программа предоставляется по принципу «как есть». Лицензиар не гарантирует: непрерывную и безошибочную работу; соответствие Программы всем индивидуальным ожиданиям Пользователя; совместимость со всеми внешними системами; неизменность условий и API сторонних сервисов; достижение Пользователем конкретного коммерческого, финансового или иного результата.
7.8. Результаты, создаваемые искусственным интеллектом, формируются автоматически и могут содержать неточности, ошибки, неполные, устаревшие или неоднозначные сведения. Лицензиар не гарантирует достоверность, полноту, уникальность или пригодность таких результатов для конкретной цели.
7.9. Пользователь обязан самостоятельно проверять результаты работы ИИ-сотрудников до принятия на их основании юридически, финансово, медицински или иным образом значимых решений. Пользователь несет ответственность за окончательное содержание сообщений и действия, выполняемые настроенными им ИИ-сотрудниками.
7.10. В максимально допустимой законодательством степени Лицензиар не несет ответственности за упущенную выгоду, потерю деловой репутации, косвенные убытки, потерю данных, действия внешних сервисов, блокировку аккаунтов в сторонних системах или последствия решений, принятых на основании автоматически сформированных ответов.
7.11. Совокупная ответственность Лицензиара по имущественным требованиям, связанным с использованием Программы, ограничивается суммой, фактически уплаченной Пользователем за последние три месяца, предшествовавшие событию, послужившему основанием требования.
Указанное ограничение не применяется в случаях, когда ограничение ответственности запрещено законом, в том числе при умышленном нарушении обязательства, причинении вреда жизни или здоровью либо применении обязательных норм о защите прав потребителей.
7.12. Лицензиар не отвечает за нарушения, вызванные: действиями или бездействием Пользователя; неправильной настройкой ИИ-сотрудников; компрометацией данных доступа Пользователя; действиями операторов связи, дата-центров, платежных систем, поставщиков языковых моделей или внешних интеграций; изменениями правил, API или ограничений сторонних сервисов; обстоятельствами непреодолимой силы; обязательными требованиями государственных органов.
7.13. Пользователь обязан возместить Лицензиару документально подтвержденные убытки, возникшие вследствие незаконного использования Программы, нарушения прав третьих лиц, неправомерной обработки персональных данных или нарушения настоящего Соглашения по вине Пользователя.
8.1. Настоящее Соглашение вступает в силу с момента его акцепта Пользователем и действует до прекращения по основаниям, предусмотренным Соглашением или законодательством Российской Федерации.
8.2. Право использования платных функций действует только в течение пробного или оплаченного периода.
8.3. Пользователь вправе в любое время отказаться от дальнейшего использования Программы, отключить автоматическое продление и обратиться к Лицензиару с заявлением о прекращении Учетной записи.
8.4. Отказ от дальнейшего использования не отменяет обязательства оплатить уже предоставленный период доступа, фактически учтенные исходящие сообщения и иную возникшую задолженность.
8.5. Лицензиар вправе приостановить доступ Пользователя полностью или частично в случае: неоплаты или недостаточности средств; нарушения настоящего Соглашения; незаконного или недобросовестного использования; угрозы безопасности Программы или третьих лиц; поступления обязательного требования государственного органа; нарушения правил сторонней интеграции; действий, способных причинить ущерб Лицензиару, Пользователям или третьим лицам.
8.6. При существенном или повторном нарушении Лицензиар вправе расторгнуть Соглашение в одностороннем порядке и прекратить доступ без сохранения возможности дальнейшего использования Программы.
8.7. При прекращении Соглашения Пользователь обязан: прекратить использование Программы; прекратить работу созданных ИИ-сотрудников; отключить интеграции; отозвать или удалить ключи API и токены доступа; удалить имеющиеся у него копии программных компонентов и документации, если такие копии предоставлялись.
8.8. Прекращение Соглашения не прекращает действие положений об интеллектуальной собственности, конфиденциальности, ответственности, разрешении споров и исполнении ранее возникших платежных обязательств.
8.9. Лицензиар вправе изменять настоящее Соглашение путем публикации новой редакции.
8.10. Если изменения ухудшают условия уже оплаченного периода, они применяются с начала следующего расчетного периода, кроме изменений, необходимых для соблюдения законодательства, обеспечения безопасности или предотвращения нарушений.
8.11. Продолжение использования Программы после вступления новой редакции в силу признается согласием Пользователя с изменениями.
8.12. Если Пользователь не согласен с новой редакцией, он обязан прекратить использование Программы до даты вступления изменений в силу.
8.13. К настоящему Соглашению применяется законодательство Российской Федерации.
8.14. До обращения в суд сторона, считающая свои права нарушенными, направляет другой стороне письменную или электронную претензию. Срок ответа на претензию составляет 30 календарных дней со дня ее получения.
8.15. Споры с юридическими лицами и индивидуальными предпринимателями рассматриваются арбитражным судом по месту государственной регистрации Лицензиара, если иная подсудность не установлена обязательными нормами законодательства. Споры с Пользователями, являющимися потребителями, рассматриваются с соблюдением предусмотренных законом правил защиты прав потребителей и подсудности.
8.16. Электронные сообщения, уведомления, сведения Учетной записи, журналы операций, платежные документы и технические данные Программы могут использоваться сторонами в качестве доказательств заключения и исполнения Соглашения.
8.17. Если отдельное положение настоящего Соглашения признано недействительным или неисполнимым, это не влечет недействительности остальных положений.
8.18. Вопросы обработки персональных данных, не урегулированные настоящим Соглашением, регулируются Политикой обработки персональных данных, размещенной Лицензиаром.

1.1.
